Contract of Public Offer

General Provisions
1.1. This offer is an official proposal from the individual entrepreneur Pikalov A.Yu., from now on referred to as the "Seller," to conclude a Purchase and Sale Agreement for goods remotely, i.e., through the Internet store, referred to as the "Agreement." It publishes a Public Offer (proposal) on the official website of the Seller "https://lavgav.ua/" (from now on referred to as the "Website").
1.2. The moment of full and unconditional acceptance by the Buyer of the Seller's proposal (acceptance) to conclude an electronic Purchase and Sale Agreement for goods is considered to be the fact of the Buyer's payment for the order on the terms of this Agreement, within the deadlines and at the prices specified on the Seller's Website.

Concepts and Definitions
2.1. In this offer, unless the context requires otherwise, the following terms have the meanings ascribed below:
- "Goods" - bio-bags (universal, rolls, monthly roll supply sets), rolls of eco-bags made from corn starch, "Dog Waste Stations," wall mounts for universal bio-bags;
- "Internet store" - by the Law of Ukraine "On Electronic Commerce," a means for presenting or selling goods, works, or services through the conclusion of an electronic agreement.
- "Seller" - a company that sells goods presented on the Website.
- "Buyer" - an individual who has entered into an Agreement with the Seller on the terms below.
- "Order" - the selection of specific items from the list of goods indicated by the Buyer when placing an order and making payment.

The subject of the Contract
3.1. The Seller transfers ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods on the terms of this Contract.
This Contract regulates the purchase and sale of goods in the Internet store, including:
- the voluntary selection of goods by the Buyer in the Internet store;
- independent placement of an order by the Buyer in the Internet store;
- payment by the Buyer for the order placed in the Internet store;
processing and delivery of the order to the Buyer's ownership under the terms of this Contract.

Order Placement Procedure
4.1. The Buyer has the right to place an order for any product presented on the Website of the Internet store and available.
4.2. Each item can be included in the order in any quantity.
4.3. In case of no goods in stock, the Company's Manager must inform the Buyer (by phone or email).
4.4. In case of the absence of goods, the Buyer has the right to replace it with a product of a similar model, refuse this product, or cancel the order.

Order Payment Procedure
5.1. Payment is made as prepayment for the order by non-cash payment in hryvnias.
5.2. In case of non-receipt of funds, the Internet store reserves the right to cancel the order.
Delivery Terms
6.1. Delivery of goods purchased in the Internet store is carried out to the warehouses of transport companies, where orders are then issued.
6.2. Documents by the legislation of Ukraine are provided to the Buyer together with the order.

Rights and Obligations of the Parties:
7.1. The Seller has the right to:
Unilaterally terminate the provision of services under this contract in case the Buyer violates the terms of this contract.
7.2. The Buyer is obliged to:
Timely payment for and receipt of the order under the terms of this contract.
7.3. The Buyer has the right to:
- place an order in the Internet store;
- conclude an electronic contract;
demand that the Seller fulfill the terms of this Contract.

Responsibility of the Parties
8.1. The Parties are responsible for non-performance or improper performance of the terms of this contract in the manner prescribed by this contract and the current legislation of Ukraine.
8.2. The Seller is not liable for:
- changes made by the manufacturer to the appearance of the Goods;
- minor discrepancies in the color of the goods, which may differ from the original solely due to different color rendering of monitors of personal computers of specific models;
- the content and accuracy of the information provided by the Buyer when placing an order;
- delays and interruptions in the provision of Services (order processing and product delivery) due to reasons beyond its control;
- unlawful actions committed by the Buyer using this Internet access;
the Buyer's transfer of their network identifiers - IP, MAC addresses, login, and password to third parties.
8.3. The Buyer, using the Internet access provided to them, independently bears responsibility for any damage caused by their actions (even if another person was using their login) to individuals or their property, legal entities, the state, or moral principles of morality.
8.4. In case of force majeure circumstances, the parties are released from fulfilling the terms of this contract. Force majeure circumstances for this contract are events of an extraordinary, unforeseen nature that exclude or objectively impede the performance of this contract, the occurrence of which the Parties could not foresee and prevent by reasonable means.
8.5. The Parties try to resolve any discrepancies solely through negotiations.

Other Terms
9.1. The Internet store reserves the right to amend this contract unilaterally, provided such amendments are published in advance on the website https://lavgav.ua/.
9.2. The Internet store is created to organize the remote sale of goods via the Internet.
9.3. The Buyer is responsible for the accuracy of the information provided when placing an order. By accepting (placing an order and subsequent payment for the goods), the Buyer gives their unconditional consent to the Seller's collection, processing, storage, and use of their data by the Law of Ukraine "On Personal Data Protection."
9.4. The payment by the Buyer for the order placed in the Internet store implies full acceptance of the terms of the purchase and sale contract (public offer).
9.5. The electronic agreement between the parties is the date of acceptance of the terms by Article 11 of the Law of Ukraine, "On Electronic Commerce."
9.6. The use of the resources of the Internet store for previewing products and placing orders for the Buyer is free of charge.
9.7. The information provided by the Buyer is confidential. The Internet store uses the Buyer's information solely for processing orders, sending messages to the Buyer, delivering goods, conducting settlements, etc.

Return Procedure for Goods of Proper Quality
10.1. Ukraine's current legislation carries out goods returns to the Internet store.
10.2. The return of goods to the Internet store is at the Buyer's expense.
10.3. Upon returning goods of proper quality, the Internet store refunds the amount paid for the goods to the Buyer upon the actual return, minus the compensation for the expenses related to the delivery of the goods to the Buyer incurred by the Internet store.

Term of the Contract
11.1. The electronic contract is considered concluded from the moment the person who sent the proposal to conclude such a contract receives acceptance of this proposal in the manner specified in Part Six of Article 11 of the Law of Ukraine "On Electronic Commerce."
11.2. Before the expiration of the term of this Contract, it may be terminated by mutual consent of the parties until the actual delivery of the goods by refunding the money.
11.3. The parties have the right to unilaterally terminate this contract in case of non-performance of the conditions of this Contract by one of the parties and in cases provided by the current legislation of Ukraine.

Please note that the online store "LoveGaw" on the official website https://lavgav.ua/ has the right, according to Ukrainian legislation, to grant the right to use the Internet platform for individual entrepreneurs and legal entities to sell goods.
